Terms of Service

The ground rules for districts using Swipe K12. Written to be readable by the people who actually sign it. Last updated August 2026.

Agreement

These terms apply to any school or district that licenses Swipe K12 software or purchases related hardware and supplies. A signed district agreement, quote, or purchase order controls where it conflicts with these terms.

Your license

We grant your district a non-exclusive, non-transferable right to use the licensed modules for the term of the agreement, for the schools and student counts listed on your order.

Authorized users are district employees, contractors acting on the district's behalf, and — where the district enables them — parents and students using the companion app.

Acceptable use

Do not attempt to breach or test our security controls without written permission, resell access, or use the service to store data unrelated to school operations.

Districts are responsible for keeping user accounts accurate and for removing access when staff leave.

Data ownership

Your data is yours. The district retains all rights to student, staff, and event data. We claim no ownership and use it only to provide and support the service, as described in our Privacy Policy.

Service availability and support

We target 99.9% monthly uptime excluding scheduled maintenance, which is announced in advance and scheduled outside instructional hours where possible.

US-based support is available on school days from 7:00 AM to 6:00 PM ET, with emergency escalation for outages affecting attendance or campus safety.

Fees

Fees are stated on your order and invoiced annually in advance unless your agreement says otherwise. Purchase-order and net-30 terms are standard for public districts.

Hardware and supplies

Scanners, printers, cards, and phone pouches are covered by the manufacturer warranty stated at purchase. Consumables are non-returnable once opened.

Term and termination

Agreements run for the school year or multi-year term listed on your order. Either party may terminate for uncured material breach after 30 days' written notice. On termination we export or delete district data on request.

Warranties and liability

We provide the service with reasonable skill and care. Except as required by law, our aggregate liability is limited to the fees paid in the twelve months before the claim. Nothing here limits liability that cannot lawfully be limited.

Changes and governing law

We notify district administrators before material changes take effect. These terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules.
